Rafale deal, BJP hits back

Bofors was Congress downhill, will Rafel deal unexplained shall be of BJP downturn? Defence deal of national importance need public explanation which can be utterted in few words but the saffron is adamant not to speak on the issue, so was Former PM Rajiv Gandhi and had to pay bitterly with charges leveled by Mr VP Singh former PM.
BJP has hit back at Congress’ allegations against the Rafale deal accusing Rahul Gandhi of misleading the Parliament and the nation. It said the UPA’s Defence Ministers had also termed the deal as confidential and accused Rahul of not doing his homework on foreign policy and security issues.
The Congress on Monday showed no signs of relenting despite being cornered in every way over its baseless allegations over the Rafale deal. During the discussion on the no confidence motion, Defence Minister Nirmala Sitharaman had quashed Rahul Gandhi’s allegations and PM Modi had clearly stated that the deal was transparent and clean.
In a press Confeerence on Monday the Congress stated that the govt had misled parliamentarians regarding the deal. The BJP retaliated with a press conference saying that Rahul Gandhi had misled the house regarding the deal.
Union Minister Ravishankar Prasad said that since the deal was confidential its details could not be shared. He said that Congress Chief had dragged the French govt too into the issue causing the latter to issue a rebuttal. He questioned how the Congress could make such statements when UPA Defence ministers AK Anthony and Pranab Mukherjee had both refused to divulge details of the deal in the house during their tenure.
It is to be noted that after Rahul Gandhi’s claims alleging discrepancies in the Rafale deal, France had issued a statement refuting his allegations and stressed on its confidentiality. Despite this the Congress continues to politicise such a confidential matter.
Meanwhile, the delivery of 36 Rafale aircrafts in a fly way condition along with associated equipment and weapons will commence from September next year, Defence Minister Nirmala Sitharaman informs Parliament. Indian Air force will not have to wait for long for the Rafale. The political allegations notwithstanding, Centre has said that the Rafale deal is on track and the delivery of the advanced planes will start in September 2019.
Defence Minister Nirmala Sitharaman has stated that the fighter jet deal with France will be completed by April 2022. Rafale will be the most modern fighter to augment the firepower capabilities of Indian Air Force and will prove to be a game changer and a force multiplier. Will her statement of Defense Minister can satisfy the Opposition parties?

North Korea begins dismantling nuclear and ballistic missile facilities

North Korea has begun dismantling key facilities at a site used to develop engines for ballistic missiles, according to an analysis of satellite imagery of the location, the first significant step towards denuclearisation following last month’s historic summit between Kim Jong-un and United States President Donald Trump.
The Sohae Satellite Launching Station has been the main site for North Korean satellite launches since 2012.
The testing facilities at the site are thought to play a role in the development of liquid-fuel engines that can also be used in North Korea’s ballistic missile programme.
The images published by 38 North, a US-based website focused on North Korea that is affiliated with the Stimson Center in Washington, were taken on July 20 and July 22, respectively.
New commercial satellite imagery of the Sohae station indicates that the North has begun dismantling key facilities, the 38 North said in a report.

Iran FM to US, ‘Be cautious’

The barbs  on Twitter between Iran and United States President Donald Trump  unending, Iranian Foreign Minister Mohammad Javad Zarif on Monday hit back at the latter, asking him to ‘be cautious’.
“COLOR US UNIMPRESSED: The world heard even harsher bluster a few months ago. And Iranians have heard them -albeit more civilized ones-for 40 yrs. We’ve been around for millennia & seen fall of empires, incl our own, which lasted more than the life of some countries. BE CAUTIOUS!” Zarif tweeted.
On Monday, Trump had cautioned Rouhani to not threaten the United States.”To Iranian President Rouhani: NEVER, EVER THREATEN THE UNITED STATES AGAIN OR YOU WILL SUFFER CONSEQUENCES THE LIKES OF WHICH FEW THROUGHOUT HISTORY HAVE EVER SUFFERED BEFORE. WE ARE NO LONGER A COUNTRY THAT WILL STAND FOR YOUR DEMENTED WORDS OF VIOLENCE & DEATH. BE CAUTIOUS!” he tweeted.
According to Iran’s state-run news agency IRNA, while addressing diplomats in Tehran on Sunday, Rouhani said, “Americans must understand that war with Iran is the mother of all wars,” reported CNN.
He, however, did not rule out the possibility of a peace agreement and said that “peace with Iran is the mother of all peace”.”Do not play with the lion’s tail, because you will regret it eternally,” Rouhani added.These comments came after Trump in May announced the US’ withdrawal from the Joint Comprehensive Plan of Action (JCPOA) or the Iran nuclear deal, which limited the country’s uranium enrichment in exchange for sanctions relief. — ANI

Jean-Claude Juncker will not arrive in the US

European Commission President Jean-Claude Juncker will not arrive in the US for talks with President Donald Trump with a specific trade offer, the Commission said on Monday. Juncker is expected to travel to Washington on Wednesday. The talks will focus on trade tensions after the US imposition of tariffs on EU steel and aluminum and Trump’s threats to extend those measures to European cars, Reuters said.
Trump’s top economic adviser, Larry Kudlow, had expected Juncker to come with a “significant” trade offer, but the Commission warned on Monday that would not happen.
Last week, European Commission president Jean-Claude Juncker said Monday that he sees “no perspective in the short term” for EU-China talks on a free trade agreement. At an EU-China summit in Beijing, he said that “if China wishes to open up it can do so.” Juncker, with European Council president Donald Tusk, met Chinese prime minister Li Keqiang. They said they hope to conclude soon a bilateral investment agreement.

EU: How migrants can be distributed

Italy has agreed to allow 450 migrants, who were picked up from an overcrowded boat Saturday, to disembark in Sicily. The migrants were rescued by two vessels from the European Union’s (EU) Frontex mission. Only 57 women and children have been allowed to land in the Sicilian port of Pozzallo. Following an appeal, Italian authorities have said that France, Germany, Malta, Portugal and Spain all agreed to take 50 migrants each.
“In this context which always sees Italy in the frontline of saving lives at sea, I ask you for a clear sign on sharing the responsibility of managing the migrant issue,” Prime Minister Giuseppe Conte said in letters sent to the governments of the 27 other EU member countries.
“This is the solidarity and responsibility that we have always asked of Europe and now, after the results obtained at the last European Council, they are beginning to become reality,” Conte posted to social media. “Let’s continue on this path with firmness and respect for human rights.”
“Germany and Italy have agreed that, in view of the ongoing talks on closer bilateral cooperation on asylum, Germany is ready to accept 50 people in this case,” a German Government spokeswoman said Sunday.
Italy’s Foreign Ministry has said Rome will allow migrants rescued by a European Union naval operation to land over the coming weeks while EU member states figure out how to divide up new arrivals, AP reported. Italy is seeking to renegotiate Operation Sophia’s mandate to prevent rescued migrants from being brought exclusively to Italy. German Foreign Minister Heiko Maas said on Monday that, over the next five weeks, EU countries will discuss how rescued migrants can be distributed in Europe. Sophia’s commander recently ordered participating ships to return to port. However, German officials said on Monday that a German ship participating in the operation had set out to sea again.

Tzipi Livni opposition leader of labor party

Zionist Union leader Avi Gabbay and Tzipi Livni announced Monday they have agreed for her to be appointed head of the opposition. Zionist Union is an alliance between Labor Party, headed by Gabbay, and Hatnua, led by Livni. As part of the deal, Livni promised to run jointly with Gabay in the next elections, though the terms of their alliance remain in murk. Gabbay cannot serve as opposition leader since he is not a lawmaker.
Israeli lawmaker and former minister Tzipi Livni was named leader of the opposition on Monday, according to a joint statement by her and the head of the Labor party. Once a member of Prime Minister Benjamin Netanyahu’s right-wing Likud, Livni quit the party in 2005. The 59-year-old politician will replaces as opposition leader former Labor chief Isaac Herzog, who resigned his seat in parliament, AFP reported. Herzog will become head of the Jewish Agency, the quasi-governmental body that deals with Jewish immigration to Israel. Labor is the largest single opposition party in the Knesset, the parliament. However, its chairman Avi Gabbay is barred from serving as opposition leader as he is not a lawmaker. Livni has served as foreign minister, justice minister, deputy premier and immigration minister.


Two Moroccan men arrested on plan to attack Rotterdam & Paris

At around 16:15 yesterday, Royal Gibraltar Police officers arrested two persons, believed to be Moroccan nationals, for immigration offences.
They had been seen landing off a vessel at the reclamation area between Eastern Beach and Catalan Bay by HM Customs officers and were initially detained by HM Customs officers at the southern end of Eastern Beach.
The two individuals, aged 26 and 22, were charged with the offence of being a non-Gibraltarian found in Gibraltar without a valid permit or certificate and appeared at the Magistrates’ Court this morning.
They both pleaded guilty to the offence, for which they were conditionally discharged. They were then remanded in custody pending their removal from Gibraltar.
Two Moroccan men have been arrested in the Netherlands after digital messages revealed their plans to carry out attacks in two cities, Rotterdam and Paris. The men were arrested on June 17 based on information provided by the Dutch General Intelligence and Security Service. The conversations between the two suspects revealed a potential plot against security services in the Netherlands and an attack in Paris following Ramadan. Police found no weapons or explosives while arresting the suspects.

Athens fires kills twenty injure 100

Greece fire  20 people have been killed by raging wildfires in Greece, government spokesman Dimitris Tzanakopoulos said, as cited by AP. He added at least 100 people have been taken to the hospital with injuries, many of them in serious condition.
The three huge fires fueled by powerful winds burned near the Greek capital, Athens.
Prime Minister Alexis Tsipras earlier said the country’s firefighting services were not able to control the disaster. Greece has requested international assistance to deal with the calamity.

Government steps in curbing the black money stashed abroad

The Government of India has taken various steps for curbing the black money stashed abroad, which have led to positive results. These steps include, inter alia, the following:
  1. India has been a leading force in the efforts to forge a multi-lateral regime for proactive sharing of Financial Information known as Automatic Exchange of Information (AEOI) which will greatly assist the global efforts to combat tax evasion. The AEOI based on Common Reporting Standard (CRS) has commenced from 2017 enabling India to receive financial account information of Indian residents in other countries.  India has also entered into information sharing agreement with the USA under the Foreign Account Tax Compliance Act (FATCA) of USA. The exchanges under FATCA have taken place for the financial years 2014, 2015 and 2016.
  2. Indian Government has been proactively engaging with foreign governments, for exchange of information under Double Taxation Avoidance Agreements (DTAAs)/Tax Information Exchange Agreements (TIEAs)/Multilateral Convention on Mutual Administrative Assistance in Tax Matters/South Asian Association for Regional Cooperation(SAARC) Multilateral Agreement.
  3. India and Switzerland have in place a Double Taxation Avoidance Agreement (DTAA), which entered into force on 29th December, 1994.  Protocol amending the Agreement came into force on 07th October, 2011.  Based on the provisions of DTAA, the two countries exchange information on a request basis, which is foreseeably relevant to the administration or enforcement of the domestic laws concerning taxes covered by the Agreement.  India and Switzerland are signatories to the Multilateral Convention on Mutual Administrative Assistance in Tax Matters (MAC) and both countries have also signed the Multilateral Competent Authority Agreement (MCAA) pursuant to which the Automatic Exchange of Information (AEOI) is activated between the two countries for sharing of financial account information effective from 01.01.2018 with first transmission in 2019.  Accordingly, India will receive the information of financial accounts held by Indian residents in Switzerland for 2018 and subsequent years, on an automatic basis.
  4. A Special Investigation Team (SIT) on Black Money has been constituted in May 2014 under the Chairmanship and Vice-Chairmanship of two former Judges of the Hon’ble Supreme Court. Investigation into cases involving substantial black money/undisclosed income, particularly black money stashed abroad, is being extensively and intensively monitored by the SIT.
  5. The Government enacted a comprehensive and a more stringent new law, namely, the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015 that has come into force w.e.f. 01.07.2015. Apart from prescribing more stringent penal consequences, this law has included the offence of willful attempt to evade tax etc. in relation to undisclosed foreign income/assets as a Scheduled Offence under the Prevention of Money-laundering Act, 2002 (PMLA).
  6. The Government gave a one-time compliance window of 3 months for providing an opportunity to taxpayers to make declarations of their undisclosed foreign assets before they were subjected to more stringent provisions of the new law i.e. the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015. 648 declarants filed declarations up-to 30.09.2015, which was the last date of filing such declarations, disclosing undisclosed foreign assets worth Rs.4,164 crores. An amount of about Rs.2,476 crore has been collected as tax and penalty in such cases.
  7. The Government has taken pro-active and effective steps whenever any credible information has been received with regard to black money stashed abroad, whether in HSBC cases, ICIJ cases, Paradise Papers or Panama Papers. These steps include constitution of Multi Agency Group in relevant cases, calling for definitive information from foreign jurisdictions, bringing the black money to tax under relevant law launching prosecutions against the offenders etc.
  8. Swiss Authorities have shared the following information regarding the Swiss National Bank (SNB) figures quoted in the media “The figures published by the SNB are regularly mentioned in the Indian media as a reliable indicator of the amount of assets held with Swiss financial institutions in respect of Indian residents. More often than not, the media reports have not taken account of the way the figures have to be interpreted, which has resulted in misleading headlines and analyses. Moreover, it is frequently assumed that any assets held by Indian residents in Switzerland are undeclared (so-called ‘Black Money’).”
  9. Further they have said “To analyze Indian residents’ deposits held in Switzerland, another data source should be used. This is the so-called “Locational Banking Statistics”, which the SNB collects in collaboration with the Bank for International Settlements (BIS).”
  10. The Data Collected by Swiss National Bank in collaboration with Bank forInternational Settlements (BIS) shows that the loans and deposits of Indians, other than Banks, in the Swiss banks decreased by 34.5% in the year 2017 as compared to 2016. Further, there has been significant reduction in Swiss non-bank loans and deposits of Indians by 80.2% between 2013 and 2017.

This was stated by Shri Shiv Pratap Shukla, Minister of State for Finance in written reply to a question in Rajya Sabha today.

‘MACRON’S WATERGATE’ IS ALEXANDRE BENALLA

French President Emmanuel Macron has decided to take the hit for the unfolding Alexandre Benalla affair, saying he’s responsible for all the actions of his violent aide, who was filmed beating demonstrators during a May Day rally.
“If they are looking for the one responsible, the only one responsible is me and me alone,”Macron told fellow parliamentary party lawmakers on Tuesday, as quoted by BFM TV. “If they want the one responsible, he’s in front of you. Let them come and get me. I answer to the French people.”
Emmanuel Macron’s presidency is being battered by its worst scandal so far and at the center of it is the protester-beating bodyguard Alexandre Benalla, a young man with a surprisingly successful career On May 1, a man wearing a police helmet was filmed roughing up unarmed protesters at an anti-Macron rally in Paris. In mid-July, he was identified as Macron’s bodyguard Benalla. This has given rise to a scandal that could swell up to what the opposition called& with French politicians baffled by the lengths to which Macron’s team has gone to protect the bodyguard.
Macron on Tuesday called the scandalous May 1 events a “betrayal,” adding that he had “trusted” Benalla. The French president at the same time stressed that he was also the one who authorized a “sanction” against the rogue aide, adding that none of his staff was above the law.
The said sanction, however, had seemingly only taken effect when the affair went public, which forced the presidential administration to sack Benalla.
Immediately after the incident, Benalla got away with only a two-week suspension without pay. The violent aide was later spotted overseeing the security of the French football team’s bus during their triumphant return from the 2018 World Cup.

Analysis of PAN Details of Sitting MPs and MLAs
Introduction
In the context of the Cobrapost’s revelation( visit: https://www.youtube.com/watch?v=TdLdsRYi8gs ) pertaining to discrepancy in PAN details of MPs and MLAs, Association for Democratic Reforms (ADR) and National Election Watch (NEW) have analysed the PAN details of 542 sitting Lok Sabha MPs and 4086 MLAs.
The PAN comprises of 4 alphabets, 4 numerical and an alphabet at the end, e.g.: ABCD4321F. Discrepancy noticed in the PAN card is that one number/alphabet is changed. ADR and NEW analysed the PAN details of re-elected MPs and MLAs in their affidavits submitted prior to last two Lok Sabha elections and last two elections in each assembly. 11 re-elected MPs and 35 re-elected MLAs have dissimilarities in the PAN details submitted by them in their affidavits.
As a policy, ADR does not disclose the PAN of candidates/winners in its reports. However, PAN can be accessed on the ECI website – eci.nic.in. Verification of correctness/ otherwise of PAN can be done on IT department website - https://www1.incometaxindiaefiling.gov.in/e-FilingGS/Services/VerifyYourPanDeatils.html?lang=eng

·         There are 7 sitting MPs and 199 sitting MLAs who have not declared their PAN details.

·         The highest number of MLAs i.e  51 who have not declared PAN details are from  INC, followed by 42 MLAs from BJP and 25 MLAs from CPI(M).
·         2 MPs each from BJD and AIADMK , and 1 MP each INC, AIUDF and NCP have not declared their PAN details.

CAIT DEMAND ROAD & HIGHWAY TO BE NAMED AFTER VAJPAYEE
CAIT URGE PRIME MINISTER TO TAKE STEPS

The Confederation of All India Traders (CAIT) in a communication sent to Prime Minister Shri Narendra Modi today has suggested that in order to keep alive the remembrance of Shri Atal Behari Vajpayee, the Rajpath Road in Delhi should be renamed as "Atal Behari Vajpayee Path".

CAIT National Secretary General Mr. Praveen Khandelwal in his communication to Prime Minister has also suggested that a tall statute of Shri Vajpayee may be erected at Vijay Chowk in Delhi near Parliament..

Shri Khandelwal also suggested that the Golden Quadrilateral Highway Network should also be named as Atal Behari Vajpayee Rashtriya Rajmarg. The Golden Quadrilateral Highway Network was the brainchild of Shri Vajpayee to connect the entire Country. If this project is named after him, it will be a true tribute to a person who saw the dream of connecting India with Highways. 

The CAIT has sent copies of the letter addressed to Prime Minister to Minister for Transport & Highways Shri Nitin Gadkari and Union Urban Development Minister Shri Hardeep Puri for necessary action.

Mr. Khandelwal said that former Prime Minister Shri Atal Behari Vajpayee was a great Statesman, patriot, visionary and one of the tallest leader the Country ever produced having a charismatic personality coupled with friends across the Country & the World. The indebted Country can take these small steps to keep him alive in the history for the next generations.

New Delhi, January 09th, 2019: Energy Efficiency Services Limited (EESL), a Super Energy Service Company (ESCO) under Ministry of Power, today announced completion of the project to replace 50,000 conventional electricity meters with smart meters in the New Delhi Municipal Council (NDMC) area.  With this, NDMC has become the first distribution company (DISCOM) in India to implement 100% smart metering solution. The adoption of smart meters will enhance consumer convenience and rationalise electricity consumption.
Hon’ble Minister for Power, New and Renewable Energy, Shri R K Singh inaugurated NDMC’s smart meter project, in the presence of dignitaries including Housing and Urban Affairs Minister Shri Hardeep Singh Puri, Shri Anil Baijal, Lieutenant Governor of Delhi; Smt Meenakshi Lekhi, MP, New Delhi constituency, Shri A.K. Bhalla, Secretary, Ministry of Power, Shri. Naresh Kumar, Chairman, NDMC, and Shri Rajeev Sharma, Chairman, EESL.
The event also included the launch of smart meter feature on NDMC 311 mobile application enabling the consumers to access various services at the tap of a finger. The smart meter tab has been added to NDMC app’s home screen. Through this convenient and easy-to-use app, consumers can now get complete clarity on their energy habits and consumption through detailed and personalised insights.

Within a short duration, 50,000 smart meters have been installed and integrated with the NDMC IT legacy system. The adoption of Smart Meters will lead to total annual savings of Rs. 12.47 crores to NDMC which include revenue due to improvement in billing efficiency. The AT&C losses are estimated to be 12.63 percent (Source: DERC Tariff Order FY2018-19)
Smart meters are part of the overall Advanced Metering Infrastructure solution (AMI) that measures and records consumers’ electricity usage at different times of the day and sends this information to the energy supplier through over-the-air communication technology. This gives consumers better access to information and enables them to make more informed decisions on the use of electricity in their homes, leading to reduced power wastage, and providing long-term carbon and financial savings.
NDMC will benefit from enhanced consumer satisfaction level resulting from better complaint management, faster restoration of outages, awareness of optimised consumption pattern, and improvement in system stability, reliability and transparency.
Inaugurating NDMC’s Smart Meter Programme, Shri R K Singh, Hon’ble Minister for Power, New & Renewable Energy, said, “India is making rapid strides in providing universal access to affordable power. The Government of India is accelerating the adoption of smart meters to ensure efficient management of electricity by checking data-entry errors, billing inefficiencies, and cutting the costs of manual meter reading through web-based monitoring system. Smart Meters will revolutionise the power sector through their vast cascade of benefits including reduced AT&C losses, better health of DISCOMs, incentivisation of energy conservation and ease of bill payments. Further, this move will generate skilled employment for the youth. I congratulate EESL on implementing the programme successfully.”

Commenting on the feat, Shri Naresh Kumar, Chairman, NDMC said, NDMC has adopted the Smart Meters Programme as a part of aligning with the Government’s plan to upgrade our national energy system. We aim to play a vital role in India’s journey towards becoming a lower-carbon economy and an energy-secure nation. We are glad to lead the way in India’s smart meter revolution. And, as the first municipal body to implement 100 percent smart metering solution, we hope to encourage our counterparts in the rest of the country to follow suit.”

Speaking at the occasion, Shri Rajeev Sharma, Chairman, EESL said, “We are pleased to support NDMC in their pursuit of energy sustainability and adoption of future-ready technologies like Smart Meters. Thrust on such efficient systems is critical for consumption and growth in a sustainable manner. Smart meters will enable consumers to monitor their consumption pattern and the corresponding cost, reducing power wastage, providing long-term carbon and financial savings. Smart meter data can ensure faster outage detection and swift restoration of service.  The meters will also provide an accurate and real-time information about energy use, enabling them to make informed decisions about their energy behaviour.”
EESL has funded and built the Smart Metering (AMI) Solution in the project area. It will also operate and manage the system enabling NDMC to benefit from smart meters with zero upfront financial investment. NDMC’s repayment to EESL will be through the monetisation of energy savings, resulting from enhanced billing accuracy, avoided meter reading costs and other efficiencies. This includes the immediate elimination of the cost of manual meter readings. These savings further enable NDMC to invest in value-added services for its consumers.
NMDC’s large-scale adoption of smart meters is a significant measure towards future-ready technologies. Smart meters pave the way for the smart grid as they enable two-way real-time communication between DISCOMs and consumers through GPRS technology.
Implementing smart meters is one of the operational performance parameters under the Government of India’s Ujwal DISCOM Assurance Yojana (UDAY). The scheme would help in reducing AT&C losses. It will also help in monitoring round-the-clock power supply eventually leading to greater efficiency and a pathway to meeting the government’s vision of 24X7 Power for All. Under its Smart Meters National Programme, EESL aims to replace 25 crore conventional meters with smart meters in India.
MoU signing for e-charging stations
EESL and NDMC also signed an MoU to install public e-charging stations. The initiative is undertaken to collaborate on promoting Electric Vehicles (including two wheelers) in the NDMC area.

A petition has been filed in the Supreme Court challenging the constitution amendment bill that reserves 10 per cent quota for poorer sections in the general category. 

A petition filed by a group, Youth for Equality and Dr Kaushal Kant Mishra, said the amendment violates the 50 per cent ceiling that had been laid down by the Supreme Court.

The Parliament has already passed the bill which will now go to the President for approval. 

Once its gets his ascent, it will become the law that will give economically weaker sections in the general category 10 per cent reservation in education as well as central and state government jobs.

Banking corruption scandal. CBI started raids ex-ICICI Bank head Chanda Kochhar – Husband – Videocon money siphoning case.
CBI has filed a case against former ICICI Bank chief Chanda Kochhar, her husband Deepak Kochhar, Videocon head Venugopal Dhoot and others in a case linked to alleged irregularities in loan. The investigating agency searched the Videocon headquarters in Mumbai and Aurangabad in Maharashtra on Thursday.
Chanda Kochhar quit as CEO and Managing Director of ICICI Bank in October over the case, which involves a loan of Rs. 3,250 crore to the Videocon Group in 2012. The case exploded last year when a whistleblower alleged that Ms Kochhar’s husband Deepak Kochhar and her family members benefited from the dealings.
Venugopal Dhoot allegedly invested crores of rupees in NuPower Renewables, a company founded by Ms Kochhar’s husband, months after the Videocon group was granted loan by the bank.
